36 Introduction EDRdatamaybeusedincivilandcriminal matters as a tool in accident reconstruction, accidentclaims,andvehiclesafety.Sincethe CrashDataRetrievalCDRtoolthatisusedto extract data from the EDR is commercially available, Mercedes-Benz USA, LLC („MBUSA“) expressly disclaims any and all liability arising from the extraction of this information by unauthorized Mercedes-Benz personnel. MBUSAwillnotshareEDRdatawithothers withouttheconsentofthevehicleownersor, if the vehicle is leased, without the consentof the lessee. Exceptions to this representation includeresponsestosubpoenasbylawenfor- cement; by federal, state or local govern- ment; in connection with or arising out of liti- gation involving MBUSA or its subsidiaries and affiliates; or, as required by law. Warning:TheEDRisacomponentoftheRes- traint System Module. Tampering with, alter- ing, modifying or removing the EDR compo- nent may result in a malfunction of the Res- traint System Module and other systems. StatelawsorregulationsregardingEDRsthat conflict with federal regulation are pre-emp- ted. This meansthatintheeventofsuchcon- flict, the federal regulation governs. As of February 2013, 13 states have enacted laws relating to EDRs.
